Acceptable Usage Policy
Introduction
This Acceptable Use Policy (“AUP”) is intended to help protect Bentley Telecom Ltd customers, and the Internet community, from the inappropriate use of the Internet. This AUP applies to anyone using Bentley Telecom Ltd Services. Your use of Bentley Telecom Ltd services constitutes acceptance of this AUP. Bentley Telecom Ltd reserves the right to revise and update this AUP from time to time. Bentley Telecom Ltd expects customers to cooperate with the company’s Support department when requested to assist in their investigations.
This AUP is divided into two sections:
• SECTION 1: Violations and Descriptions of Appropriate Use.
• SECTION 2: Reporting to Bentley Telecom Ltd.
SECTION 1: VIOLATIONS AND DESCRIPTIONS OF APPROPRIATE USE
General Violations
You must not do any of the following acts or allow anyone else to do the following acts in relation to the services and equipment:
- Breach any applicable law, commit fraud or any other criminal offence.
- Send, knowingly receive, upload, download, or use any material which is offensive, abusive, indecent, defamatory, obscene or menacing, or in breach of copyright, confidence, privacy or any other rights.
- Cause annoyance, inconvenience or anxiety to anyone else.
- “Spam”, send or provide unsolicited advertising or promotional material or, knowingly receive responses to any spam, unsolicited advertising or promotional material sent by any third party.
- Use the services or equipment in a way which could harm the services or equipment or which could negatively affect our business or reputation or our other customers.
- Breach any of our Policies or any other third party licences which apply to the services or equipment.
- Copy or modify the software unless you are legally allowed to.
- Copy, redistribute or publish any material or information in breach of any rights of a third party (including intellectual property rights).
- Circumvent any security measures in the services.
- Perform any unauthorised IP or port multicasting, spoofing, broadcasting, vectoring, filtering translation or routing.
Our Rights
You agree that we may:
- Modify any digital content we provide.
- Scan any IP addresses allocated to you for anything which may present a potential risk to our network or to other internet users.
- Refuse or terminate the display of any material or information provided by you which we believe breaches any applicable laws or third party rights (including intellectual property rights).
Enforcement
If you breach our Agreement in any way we may, at our sole discretion, without notice or refund either:
- (a) Suspend or terminate our Agreement;
- (b) Make an additional charge; or
- (c) Block access to or suspend any part of the services or equipment.
Resale
Our AUP also prohibits the resale of any Bentley Telecom Ltd service without proper authorisation from Bentley Telecom Ltd.
NETWORK DISRUPTIONS AND NETWORK-UNFRIENDLY ACTIVITY
Any activities which adversely affect the ability of other people or systems to use Bentley Telecom Ltd services or the Internet are prohibited. This includes “denial of service” (DoS) attacks against another network host or individual user.
Interference with, or disruption of, use of the network by others, network services or network equipment is prohibited.
It is your responsibility to ensure that your network is configured in a secure manner. You must not, through action or inaction, allow others to use your network for illegal or inappropriate actions. You must not permit your network, through action or inaction, to be configured in such a way that it gives a third party the capability to use it in an illegal or inappropriate manner.
Bentley Telecom Ltd is not responsible for the consequences of your failure to employ adequate security measures on your network (e.g. fraud, abuse of the service, corruption or loss of data).
NETWORK MONITORING AND SCANNING
Bentley Telecom Ltd reserves the right to run network scans and computing systems to help find and fix issues covered by this policy (for example if we think your device is vulnerable to malware). We may also scan any IP addresses allocated to you for anything which may present a potential risk to our network or to other internet users.
EXCESSIVE BANDWIDTH
If Bentley Telecom Ltd reasonably determines that excessive bandwidth is adversely affecting Bentley Telecom Ltd’s ability to provide service, Bentley Telecom Ltd may take immediate action. Bentley Telecom Ltd will attempt to notify the account owner of this as soon as possible.
CONTENT FILTERING (IWF)
Bentley Telecom Ltd uses a service provided by the Internet Watch Foundation (IWF) that prevents our customers from inadvertently accessing illegal child sexual abuse images. The list of blocked content is assessed and categorised by the IWF themselves and Bentley Telecom Ltd does not have access or visibility to see what is contained within it. No other content is included other than illegal child sexual abuse content.
E-MAIL SPAMMING
Bentley Telecom Ltd does not tolerate, endorse or participate in e-mail spamming. Sending unsolicited commercial e-mail is prohibited. We cannot authorise bulk emailing. Using a Bentley Telecom Ltd email or website address to collect responses from unsolicited commercial e-mail is prohibited. Sending large volumes of unsolicited email, whether or not that e-mail is commercial in nature, is prohibited.
All users should be aware that many people consider the following to be spamming:
- Sending e-mail to people who have not specifically asked to receive it.
- Cross-posting the same or similar messages to large numbers of newsgroups.
- Posting or sending e-mails that contain small amounts of relevant material and large amounts of irrelevant material.
Bentley Telecom Ltd considers any of the above to be unacceptable use of its services.
MAILING LISTS
Senders must be sure that recipients are aware that they are listed on the sender’s emailing list and that they themselves provided their information or authorised a third party to do so on their behalf.
All mailing lists must have a simple, working and easy-to-use “Opt-out” or “Unsubscribe” mechanism. All requests to be removed from a list must be honoured promptly.
If you use a third party to manage a mailing list on your behalf, you are still responsible for ensuring that the third party complies with this AUP. Using a third party to send “spam” which refers to a Bentley Telecom Ltd hosted website or email address is prohibited.
PROVISION OF THIRD-PARTY TOOLS
Advertising, transmitting, or otherwise making available any software, programme, product, or service that is designed to violate this AUP, or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to spam, is strictly prohibited.
SECTION 2: REPORTING TO BENTLEY TELECOM LTD
To report a violation of this AUP or for any inquiries regarding service usage, please contact our support team:

What information should be submitted?
- The IP address used to commit the alleged violation
- The date and time of the alleged violation, including the time zone or offset from GMT
- Evidence of the alleged violation
- Copies of e-mail with full header information provide all the required information, as do syslog files and firewall logs. Other situations will require different methods.
ACTIONS IN RESPONSE TO COMPLAINTS
Bentley Telecom Ltd may take any one or more of the following actions in response to complaints:
- Issue warnings: Written or verbal.
- Suspend the customer’s account: Temporary restriction of access.
- Terminate the customer’s account: Permanent closure of service.
- Invoice for administrative costs: Charges for time spent investigating breaches and/or reactivation charges.
